Does an active investigation mean I lose my licence?

No. Being under a misconduct investigation does not automatically mean you lose your licence to practise. Professional licensing is a certification of career-long competence, while misconduct is a specific process for addressing breaches of the Standards of Professional Behaviour. These remain two separate legal and operational systems.

Licensing vs. Misconduct Investigations

It is vital to distinguish between a "licensing" issue and a "misconduct" issue. A doctor may be under investigation for a specific event (misconduct) but still maintain their GMC registration (licence) until the case is concluded.

The proposed police licensing framework is expected to follow this professional model. The goal of the licence is to certify that an officer has the necessary training, fitness, and professional standing to hold themselves out as a constable.

While under investigation, your professional status is usually 'active but subject to process'.

Vetting, Professional Standards & Licensing

Many officers are concerned that licensing is "just another layer of vetting." Technically, they are distinct systems focusing on different aspects of suitability:

Vetting
Assesses integrity, security risk, and financial health. Managed by Force Vetting Units (FVU).
PSD
Addresses specific breaches of the Code of Ethics or criminal allegations. Managed by Professional Standards Departments.
Licensing
Assesses ongoing professional competence, training, and suitability for the role over time.

Licensing Myths vs. Reality

"My licence will be stripped as soon as an allegation is made."

Reality: Due process must be followed. Suspension of a licence typically requires a high legal threshold, similar to being suspended from duty.

"Restricted duties mean I'm not professionally licensed."

Reality: Officers on restricted duties (welfare, medical) are still warrant holders. Licensing frameworks include provision for temporary adjustments.
